Terms and Conditions of the Online Store  www.dreamerslandproduction.eu 

§1 General Provisions 
  1. These Terms and Conditions set out the rules of sales conducted by DREAMERSLAND Sp.  z o.o. with its registered office in Warsaw (04-713), ul. Żegańska 21/23, entered into the  National Court Register (KRS) under number 0000990809, NIP (VAT number):  9522231708, REGON: 523041221, hereinafter referred to as the “Organizer” or the “Seller.” 
  2. Through the website www.dreamerslandproduction.eu, the Organizer sells:  a) tickets for cultural and entertainment events (Part A),  
  3. b) physical products (e.g. merchandise, gadgets – Part B). 
  4. These Terms and Conditions are available on the website and constitute an integral part of  the sales agreement. 
  5. Any purchase made via the website constitutes acceptance of these Terms and Conditions. 

 

PART A – SALE OF TICKETS 

(applies only to the sale of tickets for cultural and entertainment events. The provisions relating to  physical products do not apply to tickets.) 

 

§2 Nature of Tickets 
  1. A Ticket is a document entitling the holder to entry to the specified event at the time and  place determined by the Organizer. 
  2. Tickets are sold in electronic form (PDF file sent to the Buyer’s e-mail address). 3. Tickets are not exchangeable for cash or any other benefits. 
  3. Tickets are bearer documents – the right of entry belongs to any holder of a valid ticket.  After verification, the ticket code is exchanged for a wristband, and the ticket becomes  invalid. The Organizer is not responsible for the consequences of the Buyer making the  ticket available to third parties. 

 

§3 Purchase and Payment 
  1. Tickets may only be purchased via the online store at www.dreamerslandproduction.eu.
  2. Available payment methods are described on the Store’s website and presented to the Buyer  during the purchase process.
  3. The condition for completing the purchase is full upfront payment. 

 

§4 Returns and Withdrawal (Tickets) 
  1. Pursuant to Article 38 point 12 of the Polish Consumer Rights Act, tickets for cultural and  entertainment events are non-refundable and non-exchangeable. 
  2. Refunds will only be issued in the case of complete cancellation of the event due to the  Organizer’s fault. 
  3. In the event of a change of date or venue: 

a significant change is understood as moving the event to another date or to another  city than originally announced, 

a change of venue within the same city does not constitute a significant change and  does not entitle the Buyer to a refund. 
  1. In the case of a significant change, the Buyer may cancel and receive a refund of the ticket  price, provided that the cancellation is submitted by e-mail or in writing within 7 days from  the announcement of the change. After this deadline, the right to a refund expires. 
  2. Force majeure: in the case of external events beyond the Organizer’s control that could not  have been foreseen or prevented (including natural disasters, epidemics, administrative  decisions, war, riots, failures of critical infrastructure), the event may be rescheduled or  

replaced with an equivalent event. In such a case, tickets remain valid and are non refundable. 

 

§5 Organizer’s Liability 
  1. The Organizer is not liable for tickets purchased outside official sales channels. 
  2. The Organizer is not responsible for the Buyer’s inability to attend (e.g. lateness, illness,  transport problems). 
  3. In the event of interruption of the event due to reasons beyond the Organizer’s control (e.g.  weather, administrative decisions, unforeseen circumstances), the Organizer is not obliged to  refund the ticket price. 
  4. The Organizer reserves the right to make changes to the event program, including changes  in the order of performances and their starting times, provided that these do not materially  affect the nature of the event. Such changes do not constitute grounds for a ticket refund. 

 

PART B – SALE OF PHYSICAL PRODUCTS 

(applies only to the sale of goods such as merchandise, gadgets, food products, etc. The provisions  relating to tickets do not apply to physical products.)

 

§6 Purchase and Payment 
  1. Purchases of physical products are made via www.dreamerslandproduction.eu.
  2. Available payment methods are described on the Store’s website and presented to the Buyer  during the purchase process. 
  3. The condition for completing the order is full upfront payment. 

 

§7 Delivery 
  1. Products are delivered in accordance with the delivery method selected by the Buyer. 2. Delivery costs are borne by the Buyer, unless the Store specifies otherwise. 3. The order fulfillment time is indicated for each product. 

 

§8 Withdrawal from the Agreement (Product Returns) 
  1. The Consumer or an Entrepreneur with Consumer Rights (POCK) has the right to withdraw  from a distance contract within 14 days of receiving the product, without giving any reason. 
  2. The right of withdrawal does not apply in particular to:  
  3. a) products that are perishable or have a short shelf life,  
  4. b) products delivered in sealed packaging which, once opened, cannot be returned for health  protection or hygiene reasons,  
  5. c) products made to order or personalized. 
  6. To withdraw, the Buyer must submit an unambiguous statement (by e-mail or in writing). 
  7. The Buyer must return the product immediately, no later than 14 days from submitting the  withdrawal statement. The Buyer bears the cost of return shipping. 
  8. The Seller shall refund the payment within 14 days of receiving the withdrawal statement,  provided that they may withhold the refund until the product is received or proof of return is  provided. 
  9. The refund also covers the cost of the cheapest standard delivery offered by the Store. 
  10. The Buyer is responsible for any diminished value of the product resulting from use beyond  what is necessary to establish its nature, characteristics, and functioning. 

 

§9 Product Complaints 
  1. The Seller undertakes to deliver products free from defects. 
  2. Complaints may be submitted by e-mail to: hello@dreamersland.eu. 
  3. Complaints will be processed within 14 days.

 

COMMON PROVISIONS 

§10 Complaints Regarding the Store and Tickets 
  1. Complaints concerning the functioning of the store and purchases (tickets and products) may  be submitted to hello@dreamersland.eu. 
  2. Complaints will be processed within 14 days. 

 

§11 Final Provisions 
  1. The purchase of a ticket or product constitutes acceptance of these Terms and Conditions. 
  2. The Organizer may introduce changes to the Terms and Conditions; such changes shall not  affect the rights already acquired by Buyers. 
  3. Matters not regulated herein shall be governed by Polish law, in particular the Civil Code  and the Consumer Rights Act.
